1. Acceptance of Terms

These Terms of Use ("Terms") govern access to drippyvision.com and use of software, digital content, documentation, and services made available by DrippyVision, including DrippyDeck.

By accessing or using these services, you agree to these Terms to the extent permitted by applicable law.

If you do not agree, you should discontinue use of the affected services.

Additional license terms may accompany individual software products. Where expressly identified, those terms supplement these Terms.

2. Ownership and Intellectual Property

DrippyVision and its licensors retain all applicable ownership rights in their original software, source code, object code, graphics, animations, visual effects, preset configurations, interfaces, documentation, website content, branding, and other proprietary materials.

This includes original creative and technical elements of DrippyDeck and future DrippyVision products.

These materials may be protected by copyright, trademark, trade secret, and other applicable intellectual property laws.

Accessing the website, downloading software, or purchasing a license does not transfer ownership of intellectual property.

All rights not expressly granted are reserved.

Third-party components remain subject to their respective licenses and ownership rights.

3. Limited Software License

Subject to compliance with these Terms and any applicable product-specific license, DrippyVision grants authorized users a limited, nonexclusive, nontransferable, revocable license to install and use lawfully obtained DrippyVision software for its intended purposes.

Unless expressly authorized in writing or permitted by applicable law, this license does not grant the right to distribute, sublicense, sell, or commercially exploit the software itself.

The scope, duration, permitted devices, and commercial usage rights of any paid license will be stated in the applicable purchase or license terms.

4. Prohibited Activities

Except where expressly authorized or legally permitted, users may not:

Copy, redistribute, republish, resell, or sublicense proprietary software or bundled assets.
Distribute modified versions while representing them as official DrippyVision releases.
Remove or falsify copyright, attribution, licensing, or ownership notices.
Circumvent lawful license enforcement, access controls, or security mechanisms.
Reverse engineer, decompile, or disassemble proprietary components except where applicable law permits.
Misappropriate proprietary source code, artwork, presets, or other protected expression.
Use DrippyVision branding to impersonate the developer or imply unauthorized endorsement.
Distribute malware or interfere with the security or operation of DrippyVision services.

Nothing in these Terms restricts rights that cannot lawfully be waived, including applicable interoperability, fair use, or open-source license rights.

5. Visual Effects, Presets, and Creative Assets

DrippyDeck may include original visualizer effects, procedural animations, fractals, graphical interfaces, image assets, shaders, and preset configurations.

The original copyrightable expression contained in these materials remains the property of its respective rights holders.

Users may customize software settings and create personal configurations within the functionality provided.

Such customization does not transfer ownership of the underlying DrippyVision software or proprietary assets.

These Terms do not claim ownership of users' independently created content, musical works, or other materials they lawfully own.

6. Beta, Experimental, and Development Software

DrippyVision may distribute preview, beta, experimental, or development versions of its products.

Such versions may contain defects, incomplete functionality, performance issues, compatibility limitations, or features that change or are removed.

Experimental software should not be relied upon for critical operations.

Users are responsible for maintaining appropriate backups of important settings and data.

DrippyVision does not guarantee continued availability of experimental features or compatibility with every hardware, operating system, or third-party software version.

7. Updates and Product Changes

DrippyVision may improve, modify, replace, discontinue, or update software features and services.

Updates may affect compatibility, configuration, performance, or available functionality.

Any commitments concerning purchased products, support periods, or continued access remain subject to applicable purchase terms and consumer protection law.

8. Third-Party Platforms

DrippyDeck is developed for use with compatible third-party hardware and software, including products in the Elgato Stream Deck ecosystem.

DrippyVision is an independent software brand and is not affiliated with, sponsored by, or endorsed by Elgato unless expressly stated.

Third-party product names and trademarks belong to their respective owners.

DrippyVision does not guarantee the continued availability or compatibility of third-party APIs, platforms, hardware, or software.

9. Software Availability and Compatibility

Hardware compatibility, operating system requirements, audio capture capabilities, and supported features may vary by product and version.

Product descriptions and documentation are intended to provide useful information but do not guarantee that every feature will operate identically in all environments.

Users should review published requirements before installation or purchase.

10. Purchases and Licensing

If DrippyVision introduces paid products, pricing, license duration, payment processing, taxes, refunds, and delivery terms will be disclosed before purchase.

Purchases made through third-party marketplaces may also be subject to marketplace terms.

Nothing in these Terms eliminates nonwaivable refund, warranty, or consumer rights.

Unauthorized copying or redistribution of paid software may result in license termination and appropriate legal action.

11. User Submissions and Feedback

Users may submit feedback, bug reports, suggestions, or support requests.

Users retain ownership of their independently created content.

By voluntarily providing suggestions or feedback, users grant DrippyVision a nonexclusive, worldwide, royalty-free right to use that feedback to evaluate, improve, and develop its products without an obligation to implement it or provide compensation.

This provision does not transfer ownership of separately submitted copyrighted works or confidential materials unless expressly agreed.

Users should not submit information they lack permission to share.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRIPPYVISION SOFTWARE, WEBSITES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, EXCEPT AS EXPRESSLY PROVIDED IN A SEPARATE WRITTEN AGREEMENT OR REQUIRED BY LAW.

DRIPPYVISION DOES NOT GUARANTEE UNINTERRUPTED OPERATION, ERROR-FREE SOFTWARE, UNIVERSAL COMPATIBILITY, OR THAT EVERY DEFECT WILL BE CORRECTED.

THIS DISCLAIMER DOES NOT EXCLUDE WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRIPPYVISION AND ITS LAWFULLY ASSOCIATED OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE WEBSITE OR SOFTWARE, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

TO THE EXTENT PERMITTED BY LAW, AGGREGATE LIABILITY ARISING FROM A PARTICULAR PRODUCT OR SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY THE CLAIMANT FOR THAT PRODUCT OR SERVICE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW, INCLUDING LIABILITY THAT CANNOT LAWFULLY BE LIMITED FOR FRAUD, WILLFUL MISCONDUCT, OR OTHER NONEXCLUDABLE CLAIMS.

14. Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold harmless the applicable DrippyVision operating entity and its representatives against third-party claims, losses, and reasonable expenses arising directly from the user's unlawful conduct, infringement of third-party rights, or material breach of these Terms.

This provision does not require consumers to indemnify DrippyVision for its own negligence, misconduct, or violations of law.

15. Suspension and Termination

DrippyVision may suspend access or terminate licenses when reasonably necessary to address material violations, unlawful conduct, fraud, or security threats, subject to applicable law and contractual obligations.

Upon lawful termination, users must discontinue unauthorized use of the affected software.

Termination does not extinguish rights or obligations that by their nature survive, including applicable intellectual property protections.

16. Governing Law and Disputes

Subject to applicable consumer protection laws and mandatory jurisdictional requirements, these Terms are governed by the laws of the State of Louisiana, United States, without regard to conflict-of-laws principles.

Before initiating formal proceedings, the parties are encouraged to attempt good-faith resolution through the contact information provided below.

Any forum-selection, arbitration, or class-action waiver provision should be established through a separately reviewed, legally enforceable agreement rather than presumed by these Terms.

17. Changes to Terms

DrippyVision may revise these Terms to reflect product, operational, or legal changes.

Updated Terms will be published on the website with a revised effective date.

Material changes affecting existing contractual rights will be handled in accordance with applicable law, including any required notice or consent.

18. Severability

If any provision is determined to be unlawful or unenforceable, the remaining provisions will remain effective to the extent legally permitted.

Failure to enforce a provision does not constitute a permanent waiver of that provision.
